llinois Mandates Pay Transparency in Job Postings Starting January 1, 2025
Starting January 1, 2025, employers with 15 or more employees must include pay ranges and benefits in all job postings in Illinois. This new requirement, an Amendment to the Illinois Equal Pay Act, was signed into law by Illinois Gov. J.B. Pritzker on August 11, 2023.
The new law will affect all jobs postings at Loyola University Chicago including staff, faculty, and student worker job postings. This new amendment requires that we include a pay range and benefits information in each job posting, including job postings posted on third-party job posting sites like Indeed and LinkedIn. With regards to staff job postings, Human Resources has been working with the applicant tracking system vendor so that each staff job posting will have the required salary range and benefits information on each job posting starting this fall, well in advance of January 1, 2025.
Additionally, employers are required to announce, post, or otherwise make known all opportunities for promotion to current employees no later than 14 calendar days after making an external job posting for the same position.
The following university areas are responsible for implementation and compliance with the new requirement:
- Staff Job Postings – Human Resources
- Faculty Job Postings – Faculty Affairs
- Student Worker Job Postings – Career Services
The Illinois Department of Labor (IDOL) is tasked with investigating compliance and fielding complaints. The IDOL can impose civil violations of at least $10,000 for multiple offenses. Employers are given brief “notice and cure” periods for first and second offenses. The breakdown of violations and penalties are listed below:
- First offense: 14-day cure period, up to $500 fine
- Second offense: 7-day cure period, up to $2,500 fine
- Third offense: no cure period, up to $10,000 fine
