“The Legal and Constitutional aspects of governing the British Overseas Territories – the role of a Foreign and Commonwealth Office Lawyer”
The presentation will first provide an overview of the history and constitutional nature of the British Overseas Territories as non-sovereign entities in international law. The second part of the presentation will look at how the Territories are governed, the role of the Governor and the Territory government and how rule of law and respect for human rights are promoted. The issue of self-determination and the recent referendum in the Falkland Islands will also be examined together with the challenges facing small island communities. The role of the Commonwealth in supporting small jurisdiction will also be discussed. Throughout the presentation the role of the FCO Legal Adviser in contributing to constitutional oversight will be highlighted.
