Amy E. McCarty is a Partner with Monahan & Cohen. Ms. McCarty concentrates her practice in probate litigation, contested guardianship litigation, juvenile court litigation, elder law, child welfare and mental health and confidentiality.  Ms. McCarty represents individuals, families, fiduciaries such as guardians, trustees, executors and agents under Powers of Attorney, financial institutions, medical institutions and child welfare institutions in all areas of her practice.   

Ms. McCarty specializes in guardianship and remedies to address abuse, neglect and exploitation of the elderly and disabled.  She has litigated hundreds of contested guardianship matters and has been involved in numerous cases involving financial exploitation which have resulted in significant financial recovery on behalf of the disabled adult.  Ms. McCarty is frequently consulted as an expert in mental health confidentiality issues and has participated in litigation involving novel and complex legal issues that concern the interplay between the Illinois Mental Health and Developmental Disabilities Confidentiality Act and other State and Federal statutes and regulations.  Ms. McCarty frequently lectures and provides in-service trainings on issues of surrogate decision making, guardianship, elder law, child welfare and mental health and confidentiality.

Prior to joining Monahan & Cohen, Ms. McCarty served for seven years as an Assistant Public Guardian with the Cook County Public Guardian’s Office.  While there, she served as the court-appointed guardian ad litem for abused, neglected and dependent minors in the Child Protection Division of Juvenile Court in the Circuit Court of Cook County and subsequently managed the estates of disabled adults for whom the Public Guardian was appointed guardian. 

Ms. McCarty received her juris doctorate from The John Marshall Law School and was a visiting student at the Civitas ChildLaw Center and Clinic of Loyola University Chicago School of Law.  Ms. McCarty received her Bachelor of Arts degree from the University of Michigan.
